These Terms and Conditions (“Terms”) apply to all services provided by Seal My Showers Pty Ltd (“we”, “us”, “our”, or “the Company”) to you (“Client”, “you”, or “your”). By engaging our services, you agree to be bound by these Terms.
1. Services
We specialise in waterproofing, tiling, bathroom renovations, and epoxy applications in Queensland. Services may include:
- Surface preparation, waterproofing membrane application, and sealing
- Tiling (walls, floors, showers, etc.)
- Bathroom renovations and associated works
- Epoxy flooring/coatings
All work is carried out in accordance with:
- Relevant Australian Standards (e.g., AS 3958 for tiling)
- National Construction Code (NCC) requirements
- QBCC regulations
A detailed Scope of Works will be provided in our quotation or contract and forms part of the agreement.
2. Quotations and Contracts
- Quotations are valid for 30 days unless stated otherwise.
- All prices are in AUD and include GST unless specified as exclusive.
- Variations must be agreed in writing (via variation form) and may incur additional costs and time.
3. Payment Terms
- Deposit: Typically 20–30% upon acceptance of quote/contract (or as agreed).
- Progress Payments: As per contract schedule (e.g., after preparation, waterproofing, tiling).
- Final Payment: Due upon practical completion and before handover.
Accepted methods: bank transfer, credit card (surcharges may apply), or other agreed methods.
- Overdue amounts attract interest at 1.5% per month and may result in suspension of works.
- We may exercise rights under the Building Industry Fairness (Security of Payment) Act where applicable.
4. Client Responsibilities
You agree to:
- Provide clear access to the site and ensure safety.
- Obtain necessary approvals, permits, or consents (we can advise).
- Notify us of hazards, asbestos, structural issues, or pre-existing damage.
- Ensure utilities (water, power) are available.
- Make timely decisions on selections (tiles, colours, fixtures).
- Avoid interfering with or directing workers without prior agreement.
Pre-existing defects or non-compliant substrates may require additional work at extra cost.
5. Our Responsibilities and Workmanship
- Services will be performed with due care and skill, using suitable materials.
- Work will comply with laws, standards, and QBCC licence obligations.
- Timelines may be affected by weather, material availability, site access, variations, or events beyond our control.
- Drying/Curing Times: Waterproofing, tiling, silicone, grout, and epoxy require minimum curing periods (24–48+ hours). Areas must not be used during these times.
6. Warranties
- Statutory Warranties: Apply under the QBCC Act and Australian Consumer Law (ACL).
- Workmanship Warranty: [Insert period, e.g., 12 months] defects liability period from practical completion, subject to proper maintenance and use.
Exclusions:
- Pre-existing issues, normal wear and tear, misuse, unauthorised modifications, or failure to follow care instructions.
- Waterproofing failures due to substrate movement or external factors.
7. Cancellations and Termination
- Cancellations after deposit acceptance may forfeit the deposit and incur costs for materials ordered or work performed.
- We may terminate if you breach payment or access obligations.
- Either party may terminate for serious breach by the other (with notice).
8. Liability and Insurance
- We maintain public liability and workers’ compensation insurance.
- Liability is limited to the cost of services provided or rectification of defective work (at our option).
- We are not liable for indirect or consequential loss.
- You indemnify us against claims arising from your breach of these Terms or site conditions.
- We are not responsible for damage to pre-existing structures unless caused by our negligence.
9. Site Conditions and Access
- You grant us (and subcontractors) reasonable access during business hours or as agreed.
- We will take reasonable care but are not liable for minor incidental damage (e.g., paintwork, fixtures).
- Dust, noise, and debris are inherent; we will minimise disruption where possible.
10. Materials and Selections
- Variations in tiles, colours, and finishes may occur between samples and final products.
- Natural stone/tile variations are expected.
- We are not responsible for manufacturer defects in client-supplied materials.
- Equivalent substitutions may be made if specified materials are unavailable (with notice).
11. Dispute Resolution
- Disputes must first be notified in writing.
- Parties should attempt negotiation, then mediation if required.
- Legal proceedings are subject to Queensland law.
- QBCC dispute resolution processes may apply for domestic building work.
12. Privacy
We collect and use personal information to provide services, in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
13. General
- These Terms, together with the quotation/contract and Scope of Works, constitute the entire agreement.
- No waiver of any breach is a waiver of another breach.
- If any clause is unenforceable, it is severed without affecting the rest.
- We may subcontract parts of the work.
- Force Majeure: We are not liable for delays caused by events beyond reasonable control (e.g., weather, strikes, supply shortages, pandemics).

By signing the contract or paying the deposit, you acknowledge that you have read, understood, and agree to these Terms.
